The petitioner is aggrieved by the order passed by the Assistant Registrar, Cooperative Societies, Mungeli rejecting his application by which he had prayed for a declaration that the recovery proceedings initiated by the respondent No.1 Bank is illegal. 2.

The order passed by the Assistant Registrar, Cooperative Societies is appealable under Section 77 of the Chhattisgarh Cooperative Societies Act, 1960.

In view of the alternative remedy, the writ petition is not maintainable. It is accordingly dismissed as not maintainable reserving liberty in favour of the petitioner to prefer an appeal against the order passed by the Assistant Registrar, Cooperative Societies, Mungeli. Certified copy of the order (Annexure-P-1) be returned to the learned counsel for the petitioner on supplying xerox copy thereof.
