Apprehending arrest in connection with Crime No.112/2014 registered at Police Station- Tarbahar, Bilaspur, District - Bilaspur (C.G.), for offence punishable under Section 406, 420/34 of the Indian Penal Code, the applicant has preferred this application for grant of anticipatory bail.

As per the prosecution case, it is alleged that two persons namely Manish Nigam and Deepa Nigam opened a company in the name of RENATUSS Sakh Sahkari Samiti Maryadit, at Shrikant Verma Marg, Bilaspur. Thereafter, the persons deposited amount with the assurance that it would be doubled within a short period of time. Subsequently the amount was not returned, therefore, the offence was registered. 3.
Learned counsel for the applicant would submit that, the applicant has been falsely implicated in this case. He would further submit that the
Page No.2 applicant was only working as an agent and the entire allegations are against the Manish Nigam and Deepa Nigam, who have opened the company. Therefore, he prays that the applicant may be extended the benefit of anticipatory bail.

Per contra, the learned State counsel opposes the prayer for grant of bail and would submit that charge-sheet in this case has been filed and the applicant is still absconding, therefore, he may not be released on anticipatory bail.

Considering the fact and the case diary, since the applicant is absconding till date, therefore, I am not inclined to grant anticipatory bail to the applicant.
