---- Petitioner

Versus

D. P. Tiwari Assistatn Labour Commissioner, Durg, District Durg, Chhattisgarh.

....Respondents For Petitioner :

Mr. Hemant Kesharwani, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 01/08/2017 Heard.

1. Though this Court passed an order on 24.06.2016 directing the Assistant Labour Commissioner to pass appropriate order expeditiously unless the order passed by the competent authority has been stayed by the appellate authority, it has been stated on affidavit before this Court that even after one year, no order has been passed by Assistant Labour Commissioner though there is no stay by the appellate authority. The spirit of the order of this Court required decision expeditiously but the authority has sat over the matter for one year. Therefore, In these circumstances, before initiating any proceeding, it would be appropriate to now fix a time limit for taking appropriate decision. The respondent is directed to decide petitioner's application within a period of 30 days from the date of receipt of copy of this order and if it is not done, the petitioner would be at liberty to revive the contempt petition.

2. The contempt petition is disposed off.
