1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 259/2017 registered at Police Station Khursipar Bhilai (C.G) for the offences punishable under Sections 20(B)(ii)(b) of the Narcotic Drugs and Psychotropic Substances Act.
2. As per the prosecution case, on 09.10.2017 the police received a secret information that the contraband cannabis was being transported in an Innova Car No. OR-03-J/0002 and when the said vehicle was intercepted, 10 Kgs of Ganja was seized from the possession of the applicant on his part.
3. Learned counsel for the applicant submits that the applicant has been falsely implicated and the seizure was not made in person from the applicant.
4. Per contra, learned State Counsel opposes the bail application.
5. Perused the case diary documents. Prima facie, it appears that on being intercepted the vehicle, total 60 Kgs., of Ganja was recovered from the vehicle and 10 Kgs., has been attributed to the applicant on his share.
6. Looking to the total quantity of Ganja recovered from the offending vehicle, I am not inclined to release the applicant on bail. Accordingly, it is rejected.
