The applicant has preferred this second bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is arrested in connection with Crime No.415/2019 registered at Police Station - Kotwali, District Rajnandgaon (C.G.) for the offence punishable under Sections 342, 376(D) IPC and Sections 4 of POCSO Act.

Learned counsel for the applicant submits that the prosecutrix, in her 161 Cr.P.C. statement has not stated anything against the applicant and the medical report also does not support the prosecution case.

Learned counsel for the State has opposed the bail application.

Shri Mayank Chandrakar, counsel for the complainant has no objection, if the applicant is granted bail.

This Court, vide order dated 16.01.2020 passed in MCRC No.6913/2019, has dismissed the bail application of the present applicant on merit.

After dismissal of earlier bail application of the applicant, I do not find any change in circumstances.

Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is rejected.
