Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 14/08/2020 Heard.

1. The applicants have moved this application for grant of bail as they are arrested in connection with Crime No.48/2020 registered at Police StationPandri, District-Raipur, C.G. for the alleged commission of offence under Sections 420 & 34 of IPC.

2. Prosecution case is that the applicants recovered more than Rs.1,26,000/- from different persons in the name of providing employment and thus cheated them.

3. Learned counsel for the applicants would submit that the applicants have been falsely implicated and they have not recovered money from any person. It is also submitted that investigation is complete, charge sheet has been filed and present is not a case where applicants are likely to abscond or tamper with prosecution witnesses, therefore, at this stage, the applicants may be granted bail.

4. On the other hand, learned State Counsel opposes and submits that the applicants in a very planned manner, collected huge amount of more than Rs.1,26,000/- from various persons in the name of providing employment, which was fraudulent act to cheat.

5. Taking into consideration the submissions of learned counsel for the parties, nature of allegations, amount involved and that investigation is complete, charge sheet has been filed, applicants do not seem to in a position to tamper with prosecution witnesses or flee away from justice, I am inclined to grant bail to the applicants.

6. Accordingly, the bail application is allowed. It is directed that the applicants shall be released on bail on each of them furnishing a personal bond in the sum of Rs.25,000/- along with two local sureties of the like amount to the satisfaction of the Trial Court on the condition thata) They shall appear before the Trial Court regularly on each and every date, unless exempted from appearance.

b) They shall not in any manner, tamper with the prosecution witnesses. Certified copy as per rules.
