This is the first bail application seeking for grant of bail to the Applicant who is in jail since 07.03.2018 in connection with Crime No. 07 of 2018 registered at Police Station Chilpi, Distt. Kabirdham for the offence punishable under Sections 436 and 511 IPC. 2.
The allegation against the applicant is that, the applicant on 06.03.2018 is said to have tried to set ablaze the shop of complainant Rajesh Tekam by pouring Kerosene on the door of shop, however since the applicant was seen by Prakash Lal Yadav and Kanhaiya, he immediately fled from the scene. 3.
Learned Counsel for the applicant submits that the applicant has been falsely implicated in the case and therefore he may be released on bail.

The State counsel opposes the bail application and prays for rejection of the same.

Without commenting on merits, considering the totality of the facts and circumstances of the case particularly taking in to consideration the nature of allegation levelled against the petitioner and the fact that the applicant has already remained in jail for more than two months, this Court is of the opinion that the present is a fit case where the Applicant can be enlarged on bail.

Accordingly, the application for grant of bail is allowed. It is directed that the Applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.20,000/- with one surety of the like sum to the satisfaction of the concerned Trial Court for his appearance as and when directed.
