NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No.3178 of 2017 Pushpa Tirkey After Marriage Pushpa Kujur W/o Symliyus Kujur, Aged About 45 Years Working As Assistant Teacher, Panchayat, Primary School Chhuipani, Block Bagicha, District Jashpur, Chhattisgarh.

---- Petitioner

Versus

1. State Of Chhattisgarh Through The Secretary, School Education Department, Mantralaya, Mahanadi Bhawan, New Raipur, District Raipur, Chhattisgarh.

2. Collector, Jashpur, District Jashpur, Chhattisgarh.

3. District Education Officer, District Jashpur, Chhattisgarh.

...Respondents

For Petitioner :

Mr. CJK Rao, Advocate For State :

Ms. Sunita Jain, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 20/07/2017 Heard.

1.

This petition has been filed by the petitioner seeking a direction for quashing order dated 08.03.2016 and the direction to the authority to post the petitioner at Block Kunkuri.

2.

It is noted that the legality and validity of transfer order passed way back on 08.03.2016 has been challenged. In the very essence and the nature of exercise undertaken by the respondents, it being only a matter of transfer, I am not inclined to interfere with the order after more than 1 year and 4 months, particularly, when the petitioner himself has complied with the transfer order and did not file any petition before this Court.

3.

It is submitted that the petitioner had preferred a representation. The representation has not been decided till date. At this stage, no useful purpose will be served in directing the respondents to decide the representation against the transfer order dated 08.03.2016. The chapter is closed. However, if the petitioner has any grievance in continuing at the present place and he has a case for transfer under the existing transfer policy, it will always be open for the petitioner to make representation before the competent authority. 4.

The petition is accordingly dismissed.
