The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.53/2020, registered at Police Station Kusmi, District Balrampur Ramanujganj (CG), for the offence under Sections 306 of the Indian Penal Code.

The first bail application was dismissed with liberty to the applicant to revive his prayer after examination of Pavittar Minj (applicant's father-in-law).

Applicant's wife committed suicide due to his habit of consuming liquor. In his deposition recorded before the trial Court Pavittar Minj has not supported the prosecution. 5.

Considering the entire facts situation of the case and looking to the fact that the applicant is in jail since 15-5-2020 i.e. for more than a year, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
