The short grievance, at this stage, raised by the petitioner is that the departmental appeal against the order of penalty has remained pending since October, 2016 and not decided.

The appeal of the petitioner has remained pending since October, 2016. Therefore, in these circumstances, it would be expedient to dispose off the matter at this stage with a direction to respondents No.2 & 3 to decide the petitioner's appeal within a reasonable period, outer limit of four months. The petition is disposed off.
