The grievance of the petitioner in the present writ petition is for an appropriate direction to the respondents to finalize the claim for employment of the petitioner as a land oustee.

The contention of the petitioner is that pursuant to the land, which was acquired by the respondents, the petitioner's name was shortlisted and he was also undertaken the mining vocational training under the Rules and the case of the petitioner was under consideration, but no final order has been passed by the Department till now.

Given the facts and the nature of dispute raised by the petitioner, this Court is of the opinion that ends of justice would serve if the respondents No.2 & 3 are directed to take a final decision, so far as the claim of the petitioner for
-2employment is concerned, in accordance with the Rules, Regulations and the scheme for Rehabilitation applicable in the case of the petitioner against the land, which has been acquired by the respondents. 4.
It is made clear that this Court has not expressed any opinion, so far as the merits of the case is concerned, with regard to his entitlement for employment. The respondents would be free to take a decision particularly in accordance with the Rules, Regulations and the relevant scheme for Rehabilitation applicable in the instant case. 5.
It is expected that the respondents No. 2 & 3 shall take a decision at the earliest preferably within a period of 4 months from the date of receipt of the copy of this order.
