Present is an MCC seeking for restoration of WPC No. 5715/2007, which got dismissed for want of prosecution on 18.11.2016. MCC has been filed with the delay of 242 days. Taking into consideration, the reasons assigned in the said application, the recent decision of the Coordinate Bench in MCC No. 591/2016, the application for condonation of delay has become inconsequential. Accordingly I.A. No.1 stands disposed of.
For the reasons assigned in the application seeking for restoration and finding them to be satisfactory MCC deserves to be and is accordingly allowed. The WPC No. 5715/2007 stands restored to its original position. No order as to costs.
