Learned counsel appearing for the petitioner would submit that the petitioner has joined at the present place of posting i.e. Kusumi only on 24.06.2015 and within a period five months he has again been subjected to transfer by order dated 18.11.2015 (Annexure P-6) to Balrampur on the post of Sub Divisional Officer (Quality & Control), for which, he does not possess the requisite qualifications besides that his son is also studying in Class X at Kusumi and, as such, the transfer is likely to disturb the educational qualification of his son and, therefore, he may be permitted to file representation to the State Government for redressal of his grievances and the same may be directed to be decided by the authority concerned within the specific time frame. To which, counsel for the State has no objection.

Prayer appears to be fair & reasonable.

Accordingly, it is directed that petitioner shall file representation within two weeks from today to the State Authorities and in turn the authority concerned shall decide the same in accordance with law within four months from the date of receipt of representation and result of the consideration will be communicated to the petitioner.

For the period of four weeks, effect and operation of the transfer order dated 18.11.2015 (Annexure P-6) shall remain stayed.

With the aforesaid observations, the writ petition stands finally disposed of.
