Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 13.05.2019

1. This is third bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court.

2. Earlier, the first bail application of the applicant was rejected by this Court on 03.12.2018 in MCRC No. 7246 of 2018 considering the prima facie case against the applicant. The second bail application was dismissed on 15.01.2019 in MCRC No. 9826 of 2018 for want of prosecution.

3. Counsel for the applicant submits that near about 6 witnesses have been examined, thus he wants to withdraw instant bail petition. He further submits that the trial Court may be directed to expedite the trial.

4. Permission is granted to withdraw the bail petition.

5. Accordingly the present bail petition is dismissed as withdrawn. The trial Court is directed to expedite the trial and dispose off the case as soon as possible preferably within 3 months from the date of receipt of copy of this order. Sd/- (Sharad Kumar Gupta) JUDGE kishore
