At the outset, it is submitted that during the pendency of this petition, suspension of the petitioner has now been revoked. Main relief sought in this petition is already granted. Other relief that the entire period of suspension be directed to be treated as period spent on duty. 3.

Final order has been passed in the departmental enquiry on 05-08-2017, in which, the period of suspension has been dealt with in the manner that

except suspension allowance, no other amount shall be payable to the petitioner. This order was not available for being challenged at the time of filing of this petition. Therefore, no orders are required to be passed in this petition. 4.

The petition, is therefore, disposed off with liberty to challenge the order passed in departmental enquiry by way of an appeal or otherwise including the order relating to treatment given to the period of suspension. SD/- (Manindra Mohan Shrivastava) Judge Tumane
