2. Secretary, (Appellate Authority), General Administration Department, Mantralaya, Mahanadi Bhawan, New Raipur, Raipur, Chhattisgarh

3. Under Secretary, General Administration Department, Mantralaya, Mahanadi Bhawan, New Raipur, Raipur, Chhattisgarh ---- Respondents For Petitioner :

Shri Chandresh Shrivastava, Advocate For State :

Shri Manish Nigam, Panel Lawyer S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/07/2017 Heard.

1. The short prayer made in this petition by the petitioner is that the respondents be directed to decide appeal of the deceased employee against order of penalty.

2. Learned counsel for the petitioner submits that against an order of imposition of penalty of reversion/downgrading, the husband of the petitioner preferred departmental appeal on 27.6.2016. During pendency of the said appeal petitioner's husband died. It is submitted that as in the event of order of penalty being set aside, the financial benefits would accrue to the petitioner as successor of deceased-husband.

3. This petition has been filed for direction to the respondents to decide appeal. Without commenting upon merits of the case, considering that the appeal has

-2remained pending for more than one year, it would be appropriate to dispose off the matter at this stage with a direction to respondent No.2 to decide appeal of the deceased-employee within an outer limit of two months from the date of receipt of copy of this order.

4. The petition is accordingly disposed off.
