1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 245/2014 registered at Police station Pithoura, Distt. Mahasamund (C.G) for the offences punishable under sections 399, 402 of IPC and Section 25, 27 of the Arms Act.

2. As per the prosecution case, the applicant and other co-accused were apprehended while they were making preparation to commit dacoity and from her possession knife and clothes were recovered.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case an no evidence is available against the applicant. He further submits that the applicant is in jail since 21.08.2014 and there is no progress in trial and looking to her detention, she may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of bail and submits that the bail application of similarly placed coaccused has been rejected vide order dated 15.06.2015 passed in M.Cr.C.No.5492/2015.

5. considering the fact that similarly placed co-accused have been

rejected bail by the coordinate Bench of this Court, I am not inclined to release the applicant on bail. Accordingly, it is dismissed. However, the trial Court is requested to expedite the trial. Sd/- GOUTAM BHADURI JUDGE Rao
