Hon'ble Shri Justice Rajendra Chandra Singh Samant Order on Board 17.05.2018

1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.302/2017, registered at Police Station - Civil Line, Bilaspur, District - Bilaspur, (C.G), for the offences under Sections 416, 420, 467, 468, 471, 120 -B of the Indian Penal Code.

2. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. No case is made out against him. Similarly, placed co-accused persons have been granted bail by this Court in M.Cr.C. No. 1662/2018 & M.Cr.C. No. 2166/2018,

vide order dated 23.04.2018, hence, it is prayed that he may also be released on bail.

3. Learned counsel for the State opposes the bail application and submissions made in this respect.

4. Heard counsel for both the parties and perused the case diary.

5. As per the case one forged "Rin Pustika" of Harish Vahnne the land owner was prepared by the co-accused persons and that was used for execution of sale deed on 16.12.2015, which was presented for registration on 19.07.2016 before the office of Sub-Registrar, in which this applicant impersonated as Harish Vahnne. Complaint has been lodged by the complainant- Harish Vahnne and on that basis FIR has been lodged in this case.

6. Considered on the submissions made and contents of the case diary. Similarly, placed the co-accused persons have been granted bail by this Court, hence, I am of the view that the present applicant is also entitled for grant of bail.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
