The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 204/2013 registered in Police Station Berla, Distt. Bemetara (C.G.) for offence punishable under section 302, 201/34 of Indian Penal Code.

As per the prosecution case the deceased Ratan Yadav while went to the sugarcane field of the accused a dispute arose for eating of the sugarcane. Subsequently, this applicant has caused blow on Ratan Yadav, thereby he died and after his death, his dead body was kept in his godown. Subsequently, co-accused along with this applicant made disappearance of evidence by throwing the dead body. 3.
Learned counsel for the applicant submits that no evidence is existing against this applicant and the other co-accused has been granted bail by this court in M.Cr.C. No.6813/2015 on 10/12/2015, therefore learned counsel prays for release of the applicant on bail. 4.
Learned State counsel opposes the prayer for grant of bail and submits that bail of the co-accused have been entertained on the ground
that he has made disappearance of the evidence whereas against this applicant main allegations are attributed. He further submits that applicant was absconding from 2013 and on 27/08/2015 he surrendered, therefore he may not be released on bail.

Considering the fact that applicant was absconding and he surrendered on 27/08/2015 and also case of the co-accused is different to that of the present applicant as the main allegations are attributed to this applicant for causing the death, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
