1. Both appellant Neelkanth and respondent Smt. Keertan Bai are present before this Court.

2. Heard.

3. The present is an appeal challenging the judgment and decree passed by the Family Court, Durg dismissing the appellant's application under Section 13 of the Hindu Marriage Act for dissolution of marriage.

4. On 3.5.2017, appellant Neelkanth and respondent Smt. Keertan Bai were present before this Court and the appellant made a

statement that he is willing to keep his wife with him.

5. The respondent was allowed time to think over the above statement and then, both the parties were directed to appear before this Court today.

6. Respondent Smt. Keertan Bai present before this Court states that she is residing with the appellant for last about a month and during this period, their relations were cordial.

7. Appellant Neelkanth undertakes that there shall be no difÏculty in maintaining the marital relations in future.

8. The Respondent further stated that a criminal case initiated by her is pending against the appellant, wherein, her statement has not yet been recorded in the Court. She agrees to settle the said criminal litigation also.

9. In view of the statement made by respondent Smt. Keertan Bai before this Court as also for the reason that the parties are presently residing together and appellant Neelkanth has also undertaken not to create any difÏculty for the respondent-wife in the matrimonial house, now, the appellant seeks permission of the Court to withdraw the present appeal.

10.The appellant is permitted to do so.
