NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 3491 of 2017 Dr. V. A. K. Kosaria S/o Late Shri Laxman Lal Kosaria Aged About 56 Years Working As Medical Officer, At C. H. C. Saraipali, District Mahasamund Chhattisgarh.
---- Petitioner
Versus
1. State Of Chhattisgarh Through Its Secretary, Department Of Public Health And Family Welfare, Mahanadi Bhawan, Mantralay, District New Raipur Chhattisgarh.
2. The Collector, Mahasamund, District Mahasamund Chhattisgarh.
3. The Chief Medical And Health, Officer, Mahasamund, District Mahasamund Chhattisgarh.
---- Respondents Shri R.K.Kesharwani, counsel for the petitioner/s. Shri Manish Nigam, Panel Lawyer for the State. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 01/08/2017 This petition has been filed by the petitioner aggrieved by order dated 27/05/2017. It is submitted that earlier, when the petition was filed before this Court, though this Court was not inclined to interfere with the order, liberty was given to the petitioner to make appropriate representation before the Government in view of the statement made that the place of posting has not been particularly mentioned by the respondents in the impugned order. He submits that he had made representation which has not been decided. 2.
From the perusal of order dated 14/06/2017, it is clear that the Writ Court was not inclined to interfere with the matter. It is submitted that the representation was made by the petitioner to clarify the order, but till date, it has not been communicated.
3.
Learned counsel for the petitioner submits that vide order dated 27/05/2017 (Annexure P/2), the petitioner has wrongly been shown as In-charge, District Leprosy Officer, Mahasamund whereas the charge of In-charge, District Leprosy Officer, Mahasamund is with one V.K.Singh. It is submitted that this discrepancy in the order has not been corrected till date. 4.
The order dated 27/05/2017 clearly shows that the petitioner has been posted in the District Hospital, Gariyaband. The place of posting of the petitioner is very much clear in the order. Therefore, the discrepancy in the name of post should not come in the way of the petitioner in complying with the order dated 27/05/2017. Therefore, I do not find any merit in this petition. The petition is accordingly dismissed.
