Hon'ble Smt. Justice Rajani Dubey Order On Board 03.10.2019 1.

Heard on admission.

2.

Heard on I.A.No.1/2019, application for condonation of delay in filing the revision.

3.

Perused the status report of the trial Court. From the report, it is clear that the case was fixed for final arguments on 3.9.2019 and trial is concluded.

4.

The applicant has filed this revision against the order dated 31.12.2012 passed by the Additional Sessions Judge, Kabirdham, District Kabirdham(CG) in ST No.59/2012. The revision is barred by 2180 days.

5.

The applicant has stated in the application that he has no knowledge regarding the limitation for filing the revision. Earlier, Criminal Revision No.92/2013 filed by the co-accused and Writ Petition (Cr.) No.106/2013 filed by the applicant have already been dismissed by this Court by a common order dated 30/4/2019 on the ground of delay. From the order sheets it is clear that the applicant is represented through Counsel, therefore, the ground taken by the applicant that he has no knowledge regarding the limitation for filing revision, cannot be accepted to condone such inordinate delay of more than 7 years. Accordingly, I.A.No.1/2019 is rejected. 6.

Consequently, the revision is also dismissed. Sd/ (Rajani Dubey) JUDGE sunita
