1. The present contempt petition has been filed alleging non-compliance of the Order dated 07.12.2018 passed by this Court in WPS No. 3319 of 2016, whereby the respondents were directed to consider the claim of the petitioner for pension counting his service rendered as daily wager also. Notices were issued and respondent has already entered his reply, along with the reply, he has enclosed a document dated 09.05.2019 whereby the petitioner was intimated that his case has been passed and it has been forwarded to the State Government for further steps to be taken and the recommendation has been made in favour of the petitioner.

2. The counsel for the respondent also produced a document dated 14.05.2019 which is a correspondence made by the respondent/contemnor to the Joint Director of the Regional Office

-2recommending the case of the petitioner for pensionary benefits.

3. In view of the aforesaid submission and reply that the respondent has submitted, this Court is of the opinion that so far as the compliance that was to be done by the respondent is concerned, he has already done his part, and the further steps have to be taken at the state level.

4. In view of the same, the contempt petition stands disposed off. However, it is expected that the respondent shall continue to pursue the matter at high level ensuring that the State Government takes a decision at the earliest.
