Agrawal Order On Board 30/11/2015 (1) The petitioners' grievance is that even though the petitioners had submitted their option for being absorbed in the medical education service pursuant to memo dated 3.4.2007 (Annexure P-2), even after more than 6 years, the matter has remained pending resulting in uncertainty in service.

(2) After going through the contents of the petition and the documents annexed thereto, it is revealed that the petitioners substantially belong to the Department of Health Services. On account of opening of medical college at Jagdalpur in order to cater to the need of staff, the staff of District Hospital were placed at the disposal of a medical college. Later on, in order to provide permanent staff to the medical college, option of such employees including the petitioner who were placed at the disposal of the medical college were obtained. The petitioners submitted their option long back, but till date, no decision has been taken. Such situation needs to be avoided. The petitioners have given an option long back. Therefore, the respondents should decide petitioner's case of absorption according to their own scheme of absorption and the need of staff in the medical college at Jagdalpur.

(3) The decision in this regard should be taken without an outer limit of three months from the date of receipt of copy of this order. (4) It is made clear that this Court has not given any direction for absorption of the petitioners and the respondents authorities are at liberty to decide the issued involved in the matter accordance with law.
