1) The applicant has preferred this application under Section 438 of Code of Criminal Procedure, 1973, as he apprehends his arrest in connection with Crime No.80/2021 for offence under Section 419, 468, 471/34 of I.P.C. registered at Police Station- Rajendra Nagar, Raipur (C.G.).

2) Learned counsel for the applicant has filed an application (I.A. No.4/2021) for withdrawal of the present bail application on the ground that he is now been arrested by the police and as such the present application has became infructuous. However, liberty has been sort to file appropriate bail application before the appropriate Court.

3) In view of the above, the present bail application, I.A. No.4/2021

is allowed and consequently, the present bail application is dismissed as withdrawn with the liberty as prayed for.

4) Counsel for the State has no objection to the above prayer.

5) Permission granted.

6) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
