ORDER

02.09.2016 1) This is a transfer petition whereby the wife has prayed that the petition filed by the husband under Section 9 of the Hindu Marriage Act for restitution of conjugal rights before the Family Court, North Bastar, Kanker (CG) be transferred to Family Court, Durg (CG).

2) The petitioner/wife has two children aged about 10 years and 8 years and both the children are living with the mother. It is therefore, very difficult for the petitioner to travel from Durg to Kanker along with her children.

3) In view of above, the transfer petition is allowed.

tpc 37 of 2016 4) Accordingly, case No.8A/2015 pending before the Family Court, North Bastar, Kanker (CG) is transferred to the Family Court, Durg (CG).
