Hon'ble Shri Justice P. Sam Koshy Order on Board 26/04/2019

1. The review petition has been filed seeking for review of the order dated 12.03.2019 passed in WPS No. 1712 of 2019. The review has been sought on the ground that there were certain additional grounds which the petitioner could not raise at the time of filing of previous writ petition and which according to the petitioner would be beneficial to the interest of the petitioner while assailing the order of transfer dated 08/12-2.2019. At the outset, this Court is of the opinion that the grounds raised seeking review of the order are not one which is permissible under the review jurisdiction of this Court.

2. IIf at all, if the petitioner was not satisfied with the finding of this Court while disposing the writ petition the remedy available to the petitioner

was for preferring an appeal. It is a settled position of law that additional grounds which were not raised at the first instance could not be brought before the same Court by way of a review petition the scope of the review is only limited to an error apparent on the face of record not beyond that.

3. Given the grounds in the review petition this Court does not find any strong case brought out by the petitioner by which it could be said that there was an error apparent on the face of record in the disposal of the writ petition on 12.03.2019.

4. The review petition therefore being devoid of merits stands rejected. Sd/-- (P. Sam Koshy) JUDGE Jyoti
