The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.36/2020, registered at Police Station Hasaud, District Janjgir-Champa (C.G.) for the offence punishable under Sections 294, 506 (B), 323 & 354 of IPC, Section 8 of POCSO Act and Sections 3 (2) (5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The applicant abused, criminally intimidated, assaulted and outraged the modesty of the prosecutrix, aged about 15 years. 3.

Learned State counsel would oppose the prayer for grant of bail.

Considering that the applicant is in jail since 06.02.2020 and there is no allegation of commission of rape as also for the fact that the charge sheet has already been filed, this Court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
