Learned counsel for the petitioner submits that the transfer order has been passed in violation of Clause - 2 of the Transfer Policy dated 11.07.2014 because the petitioner being post graduate in Sanskrit should not have been treated as surplus.

Learned State counsel draw attention of this Court to the under taking dated 23.07.2014 given by the petitioner that he is interested to teach Mathematics if he would have been transferred to any other school. Moreover, it is stated that the distance is hardly 7 km from the present place of posting.
