1. Learned counsel for the petitioner would submit that the petitioner's house allotment has been cancelled by respondent No.2/Collector, Janjgir-Champa without providing an opportunity of hearing to him as he is already continuing as Peon in the office of the Executive Engineer, Hasdeo Canal Water Division, Janjgir-Champa.

2. Learned State Counsel would submit that the petitioner is running dairy business in the said accommodation.

3. Be that at it may, the petitioner is directed to make a representation to the Commissioner, Bilaspur Division, Bilaspur and in turn, the Commissioner, Bilaspur Division, Bilaspur after hearing the government representative and the petitioner shall pass fresh order strictly in accordance with law as early as possible preferably within a period of 45 days from the date of receipt/production of copy of this

order.

4. With the aforesaid observation, the writ petition finally stands disposed of.
