Dr. Goverdhan Singh Thakur v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 4038 of 2017 Dr. Goverdhan Singh Thakur S/o Late Shri Jahoran Singh Thakur, Aged About 53 Years Occupation Service Assistant Professor ( Botany ), Government Post Graduate Autonomous College, Durg Thana Durg, District Durg, Chhattisgarh. ---- Petitioner
Versus
1. State Of Chhattisgarh Through Its Secretary, Department Of Higher Education, Mahanadi Bhawan, New Raipur, District Raipur (Chhattisgarh).
2. Smt. Vijay Laxmi Naidu, Assistant Professor, Government Girls College Baikunthpur, District Koriya, Chhattisgarh.
---- Respondents For Petitioner :
Shri Vinay Pandey, Advocate For State :
Shri Chandresh Shrivastava, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/08/2017 Heard.
1. The only ground of challenge to the transfer order is that the petitioner is being transferred from Durg to Baikunthpur, whereas his wife has remained posted as Assistant Grade-I Durg.
2. Learned counsel for the petitioner submits that though the petitioner is not claiming that he should be allowed to continue at the preset place, keeping in view State policy of keeping husband wife together as far as possible, the petitioner may be posted at some nearby station.
3. The petitioner has continued at the present place of posting for last four years. The attempt to keep husband wife together at a particular station or nearby station is a policy which is always subject to administrative exigency and public interest. This would be a matter for consideration for the State. The representation has already been submitted. Let a fresh application along with
copy of this order be submitted before competent authority within 10 days. If that is done, the representation must be necessarily decided within four weeks. The petitioner may pray the authority not to compel him to proceed on transfer till decision of his representation.
4. The petition is disposed off.
