Versus
1. State Of Chhattisgarh Through Its Secretary, Department Of Health And Family Welfare Development, Mahanadi Bhawan, Naya Raipur, District Raipur, Chhattisgarh.
2. District Ayurved Officer, Bilaspur, District Bilaspur, Chhattisgarh. ---- Respondents For Petitioner :
Shri Vinay Pandey, Advocate For State :
Ms. Sunita Jain, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/08/2017 Heard.
1. The only ground of challenge to the transfer order is that while transferring the petitioner from Bilaspur to Jashpur, the policy of the State to keep husband wife together has not been kept in view as the petitioner's wife is posted as Assistant Teacher Panchayat within the jurisdiction of Janpad Panchayat Masturi.
2. The petitioner's wife is an employee of Janpad Panchayat meaning thereby that she could not be transferred outside the Janpad Panchayat whereas the petitioner is State cadre officer. However, the petitioner submits that the State may atleast consider his representation for being posted in any nearby place. This can only be considered by the State Government but no ground of interference is made out by this Court. If the petitioner submits representation along with copy of this order within a period of 10 days, the same shall be considered and decided within a period of four weeks.
3. The petition is disposed off.
