The transfer order dated 14/08/2017 is challenged on the ground that this is in violation of policy dated 03/06/2015 in the matter of posting to and from core schedule area and schedule area.

At the outset, learned counsel for respondent No.4 points out that the petitioner is not the Government Servant but employee of a Society named Chhattisgarh Rajya Beej Pramanikarn Sanstha and therefore, the policy of the Government would not be applicable.

In the petition, nothing has been disclosed to show that the petitioner is a Government employee. Therefore, in these circumstances, the petitioner is not
entitled to claim benefit of circular dated 03/06/2015. The petition is accordingly dismissed.

In any case, if the petitioner is aggrieved, it would be open for the petitioner to make representation to respondent No.3. If such representation is made, the same shall be considered and decided within four weeks. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
