1. Proceedings of this matter have been taken up through video conferencing.
2. Office objection is overruled.
3. This is an application filed under Section 439 of the Cr.P.C. for grant of 10 days' bail to the applicant, as his father has
died due to COVID-19 on 06.05.2021, on humanitarian ground conditionally, who has been arrested in connection with Crime No.
420/2020, registered at Police Station - Kotwali, Ambikapur, District Surguja (CG), for the offence punishable under Section 21C of the NDPS Act.
4. Learned counsel for the applicant submits that applicant's father has died due to COVID-19 on 06.05.2021, therefore, he may be granted bail for 10 days' to participate in the necessary ceremony of his father.
5. Mr. Jitendra Pali, learned State counsel, submits that he has verified that applicant's father has died on 06.05.2021 due to COVID-19, therefore, an appropriate order shall be passed.
6. I have heard learned counsel for the parties.
7. Since applicant's father has died due to COVID-19 on 06.05.2021 and applicant being the son is granted 10 days' bail to participate in the essential ceremony of his
father. Accordingly, applicant shall be released on bail on of before 19 th of May, 2021 and he shall surrender on or before 28 th of May, 2021.
8. With the aforesaid direction the present MCRC stands disposed of. Consequently, I.A.
No.1, application for urgent hearing and I.A. No.2, application for hearing during summer vacation, also stand disposed of.
9. Certified copy by tomorrow.
