1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 08/2012 registered at P.S. Mainpur, District Gariyaband (C.G) for the offence punishable under Sections 420, 467, 468, 471, 120-B & 34 IPC.

2. As per the prosecution case, the applicant in the year 2008 submitted forged certificate of Class XII and got job of Shiksha KarmiGrade III and thereby the offence was committed.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and in the year 2012 he himself left the job by submitting resignation letter and the charge sheet in this case has been filed, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application.

5. Considering the totality of the facts and circumstances of the case, especially the fact that the charge sheet in this case has been filed and all the evidence available in this case is documentary in nature and further taking into consideration that the applicant is in jail since 05.11.2015, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He shall also appear before the trial Court as and when directed by the said Court.
