1. The transfer order is under challenge on the ground that the petitioner is being transferred from higher secondary school to high school, therefore, he has been degraded from the present post of Principal Higher, Secondary School.

2. The promotion order of the petitioner has been placed on record would show that not only the petitioner but large number of Lectures upon promotion to the cadre of Principal Higher Secondary School were posted in various High Schools. At that time, the petitioner did not challenge the order and accepted posting in the High School and joined upon promotion. Therefore, in these circumstances, I am not inclined to interfere with the order except to protect the petitioner in the manner that transfer of the petitioner shall not reduce his status which he was granted under the promotion order passed earlier and

-2that his pay shall also not be reduced and shall continue to draw the same pay scale. For other grounds which have been raised by the petitioner, it would be open for the petitioner to file representation and if it is done, the representation of the petitioner shall be decided within a period of 4 weeks.
