NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 4295 of 2017 Dr. Pramod Kumar S/o Shri Bhuneshwar Lal Thakur, Aged About 32 Years R/o Village Ranitrai, Post Balod, Tahsil Balod, District Balod, Chhattisgarh. ---- Petitioner
Versus
1. State Of Chhattisgarh Through Secretary, Livestock Development Department, Mahanadi Bhawan, Naya Raipur, District Raipur, Chhattisgarh.
2. Directorate, Veterinary Services Chhattisgarh, Indravati Bhawan, Block No. 3, Ground Flore, New Raipur, District Raipur, Chhattisgarh. ---- Respondents For Petitioner :
Mr. Ravindra Sharma, Advocate For Respondent/State :
Ms. Sunita Jain, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 07/09/2017 Heard.
1. The transfer order is under challenge on the ground that while transferring the petitioner, the Government policy of keeping husband wife together as far as possible at the same station or at nearby station has not been kept in view. It is submitted that though the petitioner has completed his normal tenure of posting and was transferred to Sukma, his wife who was posted as Veterinary Field Officer at Raipur, was transferred to Dhamtari vide order dated 14.08.2017 with a view to follow the policy of keeping husband wife together. Now by transferring the petitioner to Sukma, therefore, the transfer policy of keeping husband wife together as far as possible at the same station or at nearby place is being violated.
2. As the petitioner has completed his normal tenure of service, he has become due for transfer. It is found that the petitioner's wife was transferred from Raipur to Dhamtari by order dated 14.08.2017. Therefore, in these circumstances, the matter would require consideration by the competent authority as to whether the petitioner and his wife can be posted at the same station whether at the place where the petitioner is posted or petitioner's wife is posted or anywhere else.
3. If the petitioner prefers representation, the same shall be considered and decided within four weeks from the date of receipt of copy of this order.
4. The petition is accordingly disposed off.
