1. IA No.1, application for condonation of delay in filing this application is allowed and accordingly delay is condoned.

2. The present application has been filed seeking restoration of Writ Petition (C) No. 4024 of 2009 which got dismissed on 05.08.2015 on account of peremptory order passed by this court on 17.07.2015.

3. Learned counsel appearing for the Applicant submits that due to inadvertence on the part of counsel for the Applicant the default could not be removed and the same shall be removed promptly, to which learned counsel for the respondents have no objection.

4. Having considered the reasons specified in the application for restoration of Writ Petition (C) No. 4024 of 2009 and found them to be satisfactory, the application is allowed and Writ Petition (C) No. 4024 of 2009 is restored to its original number, subject to removing the defaults within a period of two weeks from today. No order as to costs.
