S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/09/2017 Heard.

1. This petition has been filed by the petitioner against the impugned transfer order by which the petitioner has been transferred from Bilaspur to Surajpur after having spent his posting of about 8 years. The transfer order is under challenge on the ground of his illness and that one of his children is studying in the Engineering College at Bilaspur.

2. After going through the documents on record, I find that the medical ground is not to such an extent that requires interference by the High Court. It is a matter for consideration for the competent authority. Looking to the nature

-2and illness of the petitioner, it is open for the transferring authority to consider whether the petitioner's transfer order should be cancelled or he should be continued. The petitioner has already preferred representation.

3. If the petitioner prefers fresh representation, the same shall be considered and decided by the respondent authority within a period of 4 weeks.

4. The petition is accordingly finally disposed off. Sd/-/-/ (Manindra Mohan Shrivastava) Judge Praveen
