Transfer order is under challenge mainly on the ground that the petitioner has been transferred to another district though he is a Class II employee and without his consent, he could not be transferred.

Without commenting upon the validity of this ground, I found that the transfer order contained specific clause 4, in which, it is clearly mentioned that the petitioner could be relieved to undergo transfer only when he gives consent. Therefore, in these circumstances, this petition is misconceived. If the petitioner is not inclined to proceed on transfer, he may submit his application in accordance with Clause 4 of the impugned transfer order and further steps would be required to be taken. 4.
