Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 21/09/2017 The transfer order is under challenge mainly on the ground that the petitioner's daughter is studying in 12th standard and if at this stage, he is transferred, serious hardship would be caused to the petitioner and his family. 2.

Normally, such grounds relating to transfer is not entertained by this Court but taking into consideration the fact that the daughter of the petitioner is studying in 12th standard, respondent authorities may consider either to cancel / posting of the petitioner at a nearby place or in the event, petitioner to continue till the examination of his daughter is over.

All these matters would be subject to administrative exigency. Let decision on petitioner's case be taken within a period of four weeks from today. For a period of six weeks, no coercive steps shall be taken against the petitioner.
