(1) The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 107/2014 registered at Police Station Rajgamar, Balkonagar, Korba (C.G.) for the offence punishable under Sections 420, 467, 668, 671 r/w. 34 of the Indian Penal Code.

(2) Earlier, the applicant was granted bail by order of this Court on 06/04/2015 on the condition of personal appearance before the trial Court on each and every date. The applicant failed to appear before the trial Court on 05/06/2018. Now, he has been arrested and is detained in jail since 21/08/2018.

(3) Taking into consideration the nature and gravity of offence, sufficient cause has been shown for non-compliance of this Court's order dated 06/04/2015 by the applicant.

(4) Accordingly, the second bail application is allowed. It is ordered that the applicant Ratan Lal Rajak shall be released on bail on furnishing a personal bond of Rs. 50,000/- along with one surety

of the like amount to the satisfaction of the trial Court. He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
