1. Though number of grounds have been raised in the petition to challenge legality and validity of order dated 31st October 2017 passed by the

-2Collector, learned counsel for the State raised an objection and learned counsel for the petitioner could no dispute that the petitioner has an alternative remedy of filing revision against the order of the Collector.

2. In that view of the matter, I am not inclined to examine the matter on merits. The petition is therefore dismissed with liberty to the petitioner to file revision before the Commissioner.

3. If revision petition is filed by the petitioner within a period of 30 days, the revisional authority shall do well to decide the revision on merits without entering into objection of limitation.

4. As prayed, certified copy of the impugned order (Annexure P-1) be returned to the petitioner after retaining photocopy of the same. Sd/-- (Manindra Mohan Shrivastava) Judge Praveen
