Both these bail applications are decided by this common order as they are arising out of the same crime number. 2.

The applicants have preferred these applications for grant of bail as they are arrested in connection with Crime No. 172/2015 registered in Police Station Somni, District Rajnandgaon (C.G.) for offence punishable under section 39(3) (A) (B), 48(A) Wild Life (Protection) Act 1972 & Section 3/181, 146/196 Motor Vehicle Act.

As per the prosecution case on 9/09/2015 on information received that applicants are trying to sell leopard skin forest officer and police

intercepted the applicants in the highway and applicants were caught hold with the leopard skin which was found in the Car bearing registration No. C.G. 07-G-1639.

Learned counsel for the applicants submits that applicant have been falsely implicated in this case and charge sheet has been filed, no further investigation is required, therefore applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 6.

Having regard to the facts and circumstances of the case and taking in to account the fact that seizure has already been made, charge sheet having been filed and applicants are in jail since 9/09/2015, this court is inclined to release the applicants on bail. 7.

Accordingly, the bail applications are allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
