Proceedings of this matter have been taken-up through video conferencing.

This is the second bail application under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 226/2019, registered at Police Station-Moudhapara, District-Raipur (C.G.), for the offence punishable under Section 21(B) of the Narcotic Drugs and Psychotropic Substance Act, 1985. 3.

Learned counsel for the applicant would submit that in view of medical report submitted by the State, the applicant may be allowed to withdraw I.A.No.04/2021 for temporary bail with liberty to revive the same as and when occasion arises.

Accordingly, I.A.No.04/2021 is dismissed as withdrawn with the

aforesaid liberty.

After hearing learned counsel for the applicant, I do not find any new ground or change in circumstances to entertain this second bail application. Consequently, the second bail application is dismissed. However, the trial Court is directed to conclude the trial within three months from the date of receipt of copy of this order.
