The Petitioner has moved this Court with the following prayers: "10.1 The Hon'ble court may kindly be pleased to call for the records pertaining to the subject tender for the kind perusal of this Hon'ble court; and/or 10.2 The Hon'ble Court may further kindly be pleased to issue such writ/orders/direction quashing and setting aside the impugned e-mail
communication dated 28.04.2020 passed by the respondent authorities rejecting the technical bid of the petitioner; and 10.3 The Hon'ble Court may kindly be pleased to issue such writ/orders/direction directing the respondent authorities to open the financial bid of the petitioner and suitable give effect to; and/ 10.4 The Hon'ble Court may further kindly be pleased to issue such writ/orders/direction restraining the respondent authorities from awarding the contract/work under the tender in question to the respondent no.5 and if for any reason whatsoever the work order is issued and/or agreement has been entered into, restrain the respondent authorities from proceeding further with the process, in the facts and circumstances of the case; and/or 10.5 Cost of the petition may also be granted to the petitioners; and/or 10.6 Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice"

A reply has been filed from the part of the State as well as the contesting Respondent No.5, to the effect that the tender has been finalized; the work has been awarded to the 5th Respondent and that necessary steps have been taken to have it commenced as well.

The learned counsel for the Petitioner submits that, in view of the subsequent developments, the Petitioner is not interested to proceed with the matter and seeks for permission to withdraw the matter. Permission is granted.

The writ petition is dismissed as withdrawn.
