The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.784/2016 registered in Police Station Civil Lines, District Raipur for offence punishable under sections 380, 381/34 of Indian Penal Code.

As per the prosecution case, a report was made by Mohd. Khalid on 6/12/2016 that computer and 36 tablets have been stolen from the Orion Edutech Pvt. Ltd. Subsequently, during investigation it was found that Mohd. Khalid himself has stolen the tablet with the help of the applicant and committed theft. Said tablets were further recovered from the possession of Mohd. Khalid and the present applicant. 3.

Learned counsel for the applicant submits that similarly placed coaccused has been enlarged on bail on 7/02/2017 vide M.Cr.C. No. 218 of 2017, therefore the applicant may be released on bail. 4.

Learned State counsel do not dispute the fact that similarly placed co-accused has been enlarged on bail on 7/02/2017 vide M.Cr.C. No. 218 of 2017.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused has been enlarged on bail on 7/02/2017 vide M.Cr.C. No. 218 of 2017, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
