This transfer petition has been filed by the wife for transfer of Case No.341-A of 2015 filed by the Respondent-husband in the Court of Principal Judge, Family Court, Bilaspur to the competent Court at Baloda Bazar. 2.

It is not disputed that the wife has filed a petition for grant of maintenance before the competent Court at Baloda Bazar. A proceeding under Section 498-A IPC filed by the wife is also pending at Baloda Bazar. The husband has filed a petition for grant of a decree of divorce at Bilaspur. The wife is residing at Baloda Bazar. She has no independent source of income and no order has been passed on her petition for grant of maintenance.

In view of the above, the transfer petition is allowed and Case No.341-A of 2015 (Manoj Kumar Motwani v. Smt. Bhawana @ Maya Motwani) pending in the Court of Principal Judge, Family Court, Bilaspur is transferred to the competent Court at Baloda Bazar. Sd/- (Deepak Gupta) Chief Justice Subbu
