The applicants have preferred this application under Section 439 Cr.P.C. for grant of bail as they have been arrested in connection with Crime No. 96 of 2017 registered at Police Station Saraipali, District Mahasamund (Chhattisgarh) for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act for illegally possessing 27 bulk liters of illicit country made liquor. 2.
Having heard the learned counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicants are in jail since 29.03.2017, this Court is inclined to release them on bail. 3.
Accordingly, the bail application is allowed and the applicants are directed to be released on bail on their executing a personal bond for a sum of Rs.25,000/- with one surety each for the like amount to the satisfaction of the trial Court. The applicants are directed to appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicants involve themselves in the offence of the similar nature in future, this order granting bail to the applicants shall automatically stand cancelled without reference to the Bench.
