The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.160/2021 registered in Police Station Saraipali Distt. Mahasamund (CG) for offence punishable under section 20(B) of NDPS Act, 1985.

As per the prosecution case, on 01.05.2021 on a raid being conducted, 2.300 kg. of cannabis was recovered from the possession of the applicant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no recovery was made in person from possession of the applicant, charge sheet has been filed, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Considering the facts and circumstances, the fact that the applicant is in jail since 06.02.2021 & taking into consideration the quantity of cannabis which is 2.300 kg., this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
